These Terms of Service are the agreement between you and 99Cupid. By creating an account or using the service you agree to them. If you don't agree, don't use the service.
99Cupid is operated by 99 Cupid, a sole proprietorship registered in Ontario, Canada (1001751261), at 100C Waterloo Rd., Suite 108, Timmins, ON P4N 4X5.
You must be at least 18 years old. You must be legally able to enter a contract, and you must not be barred from using the service under the laws of your country. You must not have been previously removed from 99Cupid, and you must not be a registered sex offender.
One person, one account. You may not create an account on behalf of anyone else.
You are responsible for keeping your password confidential and for everything that happens on your account. Tell us promptly at admin@99cupid.com if you think someone else has access to it.
You agree that the information you give us is accurate, and that you will keep it up to date. Impersonating someone else, or using another person's photos as your own, is grounds for immediate termination.
99Cupid costs $0.99 per month, or $9.99 per year if you choose annual billing. We price in your local currency wherever we can (for example C$0.99/month for Canada, US$0.99/month for the United States, and ₱49/month for the Philippines), so the amount and currency you'll actually be charged is always shown before you subscribe. Our Community Guidelines set this out in more detail and form part of these terms.
You keep ownership of everything you post. By posting it, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, display and distribute that content solely for the purpose of operating the service. That licence ends when you delete the content or your account, except where we are required to retain it for legal or safety reasons, or where another member has already received it.
You are responsible for your content. You confirm you have the right to post it, and that it doesn't infringe anyone else's rights.
We may remove content, suspend, or terminate any account that breaches these terms or our Community Guidelines, or where we reasonably believe it is necessary to protect other members. Where it is practical and lawful to do so, we will tell you why.
You can delete your account at any time from your settings. If we terminate your account for a breach, you are not entitled to a refund of the current period.
We do not conduct criminal background checks or verify the identity of members. We do not vet the people you meet. We provide a place to meet; we cannot vouch for anyone on it.
You are solely responsible for your interactions with other members, online and in person. Take the precautions set out in our Safety Policy, particularly around sending money, which is the single most common way people are harmed on international dating services.
We aim to keep 99Cupid running, but we do not guarantee uninterrupted access. We may change, suspend, or discontinue features. If we permanently discontinue the service, we will give notice and refund any prepaid period that you have not used.
To the fullest extent permitted by law, 99Cupid is provided "as is" and we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to the service is limited to the amount you paid us in the twelve months before the claim arose. We are not liable for indirect, incidental, special, or consequential damages, or for the conduct of other members.
Nothing in these terms excludes liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, or your rights as a consumer under applicable consumer protection legislation.
You agree to indemnify us against claims, losses and reasonable legal costs arising from your breach of these terms, your content, or your conduct toward other members.
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Disputes will be heard in the courts of Ontario. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer laws in your country of residence.
We may update these terms. If a change is material, we will email registered members at least 30 days before it takes effect. Continuing to use the service after that means you accept the new terms.
